Welcome to HessaPay. These Terms of Service ("Terms") govern your access to and use of HessaPay's website, mobile applications, and services. Please read these Terms carefully before using our services.

1. Acceptance of Terms

By accessing or using HessaPay, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

You represent that you have the legal capacity to enter into this agreement and that the information you provide is accurate and complete.

2. Description of Service

HessaPay is an expense tracking and splitting platform designed for users in the GCC region. Our service allows you to:

  • Track shared expenses with friends, family, and colleagues
  • Calculate and manage balances between group members
  • Scan and store receipts for record-keeping
  • Manage multi-currency expenses (KWD, AED, SAR, and more)

Important: HessaPay does not hold money, process payments directly, or act as a bank or financial institution. We are a tracking and calculation tool to help you manage shared expenses.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate and complete registration information
  • One account per person is permitted
  • You are responsible for all activities that occur under your account
  • Notify us immediately if you suspect unauthorized access to your account

4. Acceptable Use

You agree to use HessaPay only for lawful purposes. You may not:

  • Use the service for money laundering, fraud, or any illegal activities
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Harass, abuse, threaten, or harm other users
  • Upload malicious content, viruses, or harmful code
  • Interfere with the proper functioning of the service
  • Use automated systems to access the service without permission
  • Impersonate another person or entity

5. User Content

  • You retain ownership of content you upload (receipts, expense descriptions, notes)
  • You grant HessaPay a non-exclusive license to use, store, and process your content solely to provide the service
  • You are responsible for ensuring you have the right to share any content you upload
  • We may remove content that violates these Terms or applicable laws

6. Intellectual Property

  • HessaPay, our logo, and related trademarks are the property of HessaPay
  • All content, design, graphics, and code are protected by intellectual property laws
  • You may not copy, modify, distribute, or create derivative works without our written permission
  • You may not use our branding or trademarks without authorization

7. Third-Party Services

HessaPay may integrate with third-party services (payment providers, analytics, cloud services). Please note:

  • Third-party services are governed by their own terms and privacy policies
  • We are not responsible for the practices or content of third-party services
  • Your use of third-party services is at your own risk

8. Disclaimers

  • The service is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee the accuracy of expense calculations — users should verify all amounts
  • We are not responsible for disputes between users regarding shared expenses or payments
  • We do not provide financial, tax, or legal advice
  • We do not guarantee uninterrupted or error-free service

9. Limitation of Liability

To the maximum extent permitted by law:

  • HessaPay is not liable for any indirect, incidental, special, or consequential damages
  • Our maximum liability is limited to the fees paid by you to HessaPay in the past 12 months (if any)
  • We are not responsible for loss of data, profits, or business opportunities
  • We are not liable for service interruptions or downtime

10. Termination

  • You may terminate your account at any time by contacting us
  • We may suspend or terminate accounts that violate these Terms
  • We may discontinue the service with reasonable notice
  • Upon termination, your data will be handled according to our Privacy Policy

11. Modifications to Terms

  • We may update these Terms periodically
  • Changes will be posted on this page with an updated "Last updated" date
  • Continued use of the service after changes constitutes acceptance
  • We will notify users of significant changes via email

12. Governing Law

  • These Terms are governed by the laws of the State of Kuwait
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuwait
  • HessaPay complies with Central Bank of Kuwait regulations for financial technology services
